As artificial intelligence transforms the advertising landscape, ensuring compliance with Australian advertising codes and legislation has become more complex. While AI offers exciting creative possibilities, it also introduces new compliance considerations that require careful attention.

Key areas to watch when using AI in your advertising:

Transparency and accuracy – Disclose AI-generated content where material to consumer decisions, and verify all factual claims, statistics, and product descriptions are accurate and substantiated

Age-restricted products – Advertisements for gambling, alcohol, or other age-restricted products and services should be carefully reviewed to ensure AI hasn’t created content appealing to minors or vulnerable groups

Therapeutic goods and health services – AI content must still meet TGA pre-approval requirements and AHPRA guidelines, particularly regarding before/after images, testimonials, and treatment outcome expectations

Deepfakes and synthetic media – Ensure AI hasn’t created misleading representations of real people, false endorsements, or misused celebrity likenesses without permission

Human oversight – Maintain human review and approval of all AI-generated content before publication to catch errors, misleading representations, or compliance issues
